Plain-language summary

Commitments is a habit-tracking app for iPhone. You can track your own commitments and, optionally, share them with friends in Circles and one-to-one Pacts. Most of the app is free; Commitments+ is an optional paid upgrade for hosting your own shared groups, sold through the App Store. Your data lives in your own iCloud account, we don't run a server that holds it. Be kind to the people you share with, only share content you're allowed to share, and remember the app is a motivational tool, not professional advice. You can delete your account and data, or cancel a subscription, at any time.

1. Who these terms are between

These Terms of Service ("Terms") are an agreement between you and Maximilian Güth ("we", "us", "our"), the provider of the Commitments app ("the App"). By downloading, accessing, or using the App you agree to these Terms. If you don't agree, don't use the App.

These Terms incorporate our Privacy Policy by reference.

2. The service

Commitments lets you:

  • Create and track personal commitments (habits and one-time goals), including quantity-tracked ones, and build streaks.
  • Optionally share commitments with others through Circles (groups) and Pacts (a one-to-one shared commitment that both people tick to keep).
  • Send supportive Nudges to people in your Circles, attach photos to commitments, and earn in-app Sparks and Streak Freezes.
  • Set a personal "Vibe" that adjusts how the App phrases its own encouragement and reminders to you.

We may add, change, or remove features over time (see Section 11).

3. Eligibility and your account

  • You need a compatible Apple device and an Apple ID, and you sign in with Sign in with Apple. We don't operate separate usernames or passwords.
  • You must be at least 13 years old, or the minimum age of digital consent in your country, to use the App.
  • You're responsible for activity that happens under your account and for keeping your Apple ID secure.

4. Commitments+ (paid subscription)

The App is free to use. Commitments+ is an optional paid upgrade.

  • What it unlocks. Commitments+ is required to host your own shared groups, creating your own Circle and acting as its host. People you invite use shared features (joining Circles, ticking, photos, nudges, Pacts with you) for free. We call this "host pays": one paying host, any number of free guests.
  • Plans. Commitments+ is offered as a yearly subscription (with a 14-day free trial), a monthly subscription, and a one-time "lifetime" purchase. It supports Family Sharing. The current price for each is shown in the App at the point of purchase and may change over time; Apple displays prices in your local currency.
  • Billing is by Apple. All purchases are processed by Apple through your Apple ID under the App Store's terms. We never receive or store your payment details.
  • Auto-renewal. Subscriptions renew automatically for the same period unless you cancel at least 24 hours before the current period ends. Your Apple ID is charged for renewal within 24 hours before the period ends. A free trial (if offered) converts to a paid subscription unless cancelled before it ends; any unused portion of a free trial is forfeited when you buy a subscription that includes it.
  • Managing and cancelling. You manage, change, or cancel a subscription in iOS Settings → [your name] → Subscriptions.
  • Refunds are handled by Apple under the App Store's policies, not by us. Deleting your account or your data in the App does not cancel a subscription, because the purchase is tied to your Apple ID.

5. Sparks and Streak Freezes (virtual items)

The App includes a free in-app gamification layer. Sparks are points you earn by using the App; Streak Freezes are a virtual item bought with Sparks that protects a streak on a missed day.

  • Sparks and Streak Freezes have no monetary value, cannot be bought for money, cannot be exchanged for money, and cannot be transferred.
  • They are a licensed, revocable part of the service. We may change how they're earned or spent, adjust balances to correct errors or abuse, or discontinue them, without owing you anything.

6. Your content and the people you share with

  • Your content. Commitments, photos, Circle names, nudges, and other content you create are yours. You're responsible for it and confirm you have the right to share anything you upload.
  • What you share is visible to your group. When you put content in a Circle or a Pact, the other members can see it (for example your display name, avatar, the shared commitments, whether you kept them, attached photos, and activity). Don't share content, including photos or information about other people, that you don't have the right to share, and only invite people you actually want to share with.
  • License to operate the service. You grant us only the limited permission needed to store, sync, and display your content within the App and to the Circle members you choose. We do not own your content, don't use it to train anything, and don't sell or share it. (As explained in the Privacy Policy, your content is stored in your own iCloud account; we don't operate a server that holds it.)
  • No illegal or harmful content. Don't use the App to store or share anything unlawful, infringing, abusive, harassing, or that violates someone else's rights.

7. Acceptable use

You agree not to:

  • Use the App to harass, abuse, threaten, or harm others, including through nudges or Circle content.
  • Attempt to access data of users who haven't shared it with you, or interfere with, reverse-engineer, or disrupt the App or Apple's services beyond what the law expressly permits.
  • Use the App in violation of any applicable law or of Apple's App Store terms.

We may suspend or limit access that breaches these Terms.

8. Deleting your account and data; termination

  • You can delete your account and data at any time via Settings → "Delete Account and All Data", or by deleting the App and removing its data from iCloud. (Again, this does not cancel a Commitments+ subscription; manage that in iOS Settings → Subscriptions.)
  • We may suspend or terminate your access if you materially breach these Terms or use the App unlawfully.
  • Provisions that by their nature should survive termination (e.g. disclaimers, liability limits, and the sections on virtual items and governing law) survive.

9. Disclaimers

  • The App is provided "as is" and "as available", without warranties of any kind to the fullest extent permitted by law. We don't guarantee the App will be uninterrupted, error-free, or that data will always sync (syncing depends on Apple's iCloud and your network/Apple-ID state).
  • Commitments is a motivational and organizational tool, not medical, health, psychological, financial, or other professional advice. Don't rely on it as a substitute for professional guidance, and consult a qualified professional for decisions that warrant one.
  • Nothing in this section limits rights that mandatory consumer-protection law gives you.

10. Limitation of liability

To the fullest extent permitted by applicable law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost data or lost profits, arising from your use of the App. Nothing here excludes or limits liability that cannot lawfully be excluded, including, where applicable, liability for intent, gross negligence, personal injury, or rights you have as a consumer under mandatory law.

11. Changes to the App and to these Terms

We may modify, suspend, or discontinue parts of the App at any time. We may also update these Terms; if we make material changes we'll update the date above and, where appropriate, notify you in the App or on this page. Continuing to use the App after changes take effect means you accept the updated Terms.

12. Apple App Store terms

Because the App is distributed through Apple's App Store, the following apply in addition to the above:

  • These Terms are between you and us only, not with Apple. Apple is not responsible for the App or its content.
  • Your license to use the App is a non-transferable license to use it on any Apple-branded device you own or control, as permitted by the App Store Usage Rules in Apple's terms.
  • Apple has no obligation to furnish any maintenance or support for the App. Any support questions go to us at the contact below.
  • To the extent permitted by law, Apple has no warranty obligation for the App, and we, not Apple, are responsible for any product warranties and for addressing any claims relating to the App (including product-liability, legal/regulatory, and intellectual-property claims), subject to these Terms.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
  • You represent that you are not in a country subject to a U.S. Government embargo or designated as "terrorist supporting," and that you are not on any U.S. Government list of prohibited or restricted parties, and you will comply with applicable third-party terms when using the App.

13. Governing law

These Terms are governed by the laws of the Federal Republic of Germany, without regard to conflict-of-laws rules and excluding the UN Convention on Contracts for the International Sale of Goods (CISG), and subject to any mandatory consumer-protection rights of your country of residence. If you are a consumer, this choice of law does not deprive you of the protection of provisions that cannot be derogated from by agreement under the law of your country of habitual residence, and mandatory law determines which courts are competent.
